Adult and Youth Baseball and Softball Bats

PRODUCT WARRANTY

This warranty applies to all but Coach Pitch bats

WHAT IS COVERED:

Anderson Bat Company (“ABC”), warrants to the original purchaser only, that the bat purchased (a) conforms to ABC’s specifications, and, (b) is free from defects of materials and workmanship.

A defect in materials is a preceding condition that exists before any use and before damage is done and is not inherent in the materials used for construction that causes the failure of the product during the useful life when used for its intended use.

A defect in workmanship is a preceding condition that exists before use and before any damage is done and is the unforeseen result of the manufacturing or assembly process that causes a failure of the product during its useful life in its intended use.

LIMITATIONS OF COVERAGE:

ABC does not warrant any product that has been (a) modified, (b) used in a batting cage, (c) used for a purpose other than for which it was designed, (d) used with balls exceeding 525 pounds of compression, (e) used in temperatures below 60 degrees Fahrenheit/15 degrees Celsius, (f) used as a “team bat,” (g) purchased through auction sites, or (h) has exceeded its useful life.

Unless preceded by a defect in material or workmanship, this warranty does not include ball damage or any damage done through normal use including but not limited to: dents, waves, dings, gouges, chips, scratches, scuff marks, cleat marks, bat rack scratches or bag wear. “My bat is dead;” “My bat has lost its pop;” “My bat sounds funny;” or an inappropriate product selection are not reasons for a return and are not covered by this warranty unless a preceding defect in materials or workmanship is found by close inspection.

Worn grips are not covered by this warranty.

Many bats with very minor (but normal) damage from use are still safely playable and well within any rules (published or otherwise), and yet may still be disqualified by an umpire in competition. Most (if not all) umpires are not properly trained to assess the structural integrity of a bat and therefore not qualified to accurately make a determination of this kind. Therefore this warranty does not include “umpire discretion” as a valid reason for replacement. The final determination of product integrity and playability for a returned bat will be at the sole discretion of ABC regardless of any prior judgment of umpires in competition.

From time to time a dent occurs through normal use, under reasonable conditions, that prematurely shortens the product service through no fault of the user or the manufacturer. Although this type of damage is not covered unless it is preceded by a defect in materials and/or workmanship, as a matter of grace, ABC offers a one-time replacement for bats rendered unusable by this type of denting within the warranty period. Proper use and product service restrictions still apply for any returned bat to be eligible for the one-time replacement. A one-time replacement will only be replaced with the same model and size as the returned product and the warranty time limit will not be restarted from the date of receipt of the replacement bat.

All bats see service in a very demanding impact environment. All bats wear out. The average player is of the appropriate age, size and weight (up to and including the 75th percentile) for the chosen product. A player being larger, heavier or stronger than the 75th percentile, playing in more than 25 games a year, playing in cold and/or wet conditions, taking extended regular batting practice, hitting harder or heavier than regulation balls or simply choosing the wrong product are just a few of the things that can significantly shorten the expected product service life. This warranty does not cover bats that have worn out because their use has exceeded their useful life.

If, by close inspection, the product is deemed by ABC to exhibit more than the typical wear of normal use by an average user in a 12 month period, the end of reasonable product service due to the use of the product beyond its useful life may be declared regardless of the time passed.

This warranty is not valid without an original receipt from an Authorized ABC dealer. Third party receipts, such as PayPal, Paypoint, etc., will not be accepted.

LENGTH OF WARRANTY:

This warranty expires either (a) twelve months from the date of purchase or (b) after reasonable product service has exceeded the useful life of the bat, whichever occurs sooner.

The time limitation in the warranty begins the day the bat is purchased. The original purchase date is established by the date that appears on the original sales receipt from an ABC Authorized dealer. Without the original receipt from an Authorized ABC dealer, a start date cannot be established. Therefore if the original receipt is not produced or is from somewhere other than an Authorized ABC dealer, the warranty is not valid.

Reasonable product service for the useful life of the bat is the typical amount of wear and tear that a single average player might cause during a single year of play (approximately 25 games and 25 practices or about 1,500 hits).

WHAT ANDERSON BAT WILL DO:

If the original purchaser discovers within 12 months after the date of purchase and prior to concluding reasonable product service has exceeded the bat’s useful life, a failure of the product to conform to ABC’s specifications or a defect in materials or workmanship, the original purchaser must notify ABC promptly by filling out a warranty claim form for a Return Authorization Number (RA#) and return instructions.

ABC shall have the option to either repair or replace, at its discretion, bats found to have manufacturing or material defects. A returned bat will only be replaced with the same model and size as the one returned. The substitution of a comparable model will be made at ABC’s discretion should a discontinued bat no longer be available. If a replacement bat is sent, the replacement bat does not start a new 1-year warranty period unless explicitly stated in the Bat Inspection Report.
